The deposit (as indicated in the statement of costs) is excluded by the owner as partial compensation for the non-return of the rental vehicle in good condition, ordinary wear, as at the time of receipt, for the reimbursement of damaged, missing or broken items or for the taking into account of the rental costs when returning the vehicle by the renter. It is agreed and UNDERSTOOD by the renter that the lessor is not responsible for damages, inconveniences or loss of time caused by the accident, breakdown or malfunction of the rental vehicle. THE RENTER ALSO AGREES to release the Owner from any claim in the event of loss or damage to the property or damage suffered by persons (including death) resulting from the use, operation or possession of this rental vehicle and to keep it unharmed. The Renter also undertakes to keep the Owner harmless in the event of loss or damage to the Tenant`s personal property while it is being transported in or on the Rental Vehicle, including loss or damage due to fire, water, theft or any other cause. The lessee expressly undertakes to exempt the lessor from all losses, costs, damages, attorneys` fees and/or liability costs related to the application of the aforementioned rental agreement by the lessor, including the costs incurred during the confiscation or attempted recovery of the outstanding rent and, in the event of recourse by the lessor, of recovery of ownership of such rental property and/or application of any of the conditions, Conditions and/or provisions of this Agreement. It is understood and agreed that, for each legal action, the place of business is in the circle of the OWNER. All damages are paid upon return of the rental vehicle. In case of return of the crafts, if there is any damage, the tenant pays either on bail or with money / check.

IF THE DAMAGE EXCEEDS THE DEPOSIT, THE RENTER REMAINS RESPONSIBLE FOR ALL DAMAGE CAUSED TO THE BOATS OR APPLIANCES. In case of malfunction, breakdown or discovery of a defect after receipt of the rental vehicle, LESSEE will immediately report them to the OWNER. CONTINUED USE IS EXCLUSIVELY AT THE RISK OF THE TENANT AND, THEREFORE, THE TENANT ASSUMES ALL DEBTS RELATED TO INJURIES AND DAMAGES SUFFERED BY ALL PERSONS AND PROPERTY THAT MAY BE AFFECTED BY THE CONTINUED USE. The lessor`s ability to provide a rental vehicle when it is booked depends on the return of the device by the previous renter or any other reason that is not controlled by the lessor.
